Rental Agreement

RENTAL AGREEMENT

This Rental Agreement and Liability Waiver (“Agreement”) is made and entered into by and between: Giant Peach Game Rentals, LLC and the individual (“Renter”) who is submitting this form.  By proceeding with the rental of games from Giant Peach Game Rentals, LLC, the Renter confirms they have read, understood, and agreed to all terms and conditions outlined in this Agreement, including but not limited to responsibilities, liabilities, cancellation, and weather-related policies.

 

1. Rental Period

The rental period begins and ends on the date and time outlined within correspondence between Giant Peach Game Rentals, LLC and Renter.

Renter may request changes to the event location or rental duration by providing written notice to Giant Peach Game Rentals, LLC at least 48 hours prior to the scheduled event date and time.  All requested changes are subject to availability and approval by Giant Peach Game Rentals, LLC.

Renter acknowledges that changes to the rental location, delivery distance, setup requirements, rental duration, or event timing may result in additional fees, including but not limited to increased delivery, travel, labor, or rental charges.  Any applicable additional charges will be communicated to the Renter and must be accepted before the requested changes are confirmed.

Requests received less than 48 hours before the scheduled event may not be accommodated and, if approved, may be subject to additional late change fees at the sole discretion of Giant Peach Game Rentals, LLC.

2. Assumption of Risk

I acknowledge that participation in games rented from Giant Peach Game Rentals, LLC involves potential risks, including but not limited to:

  • Trips, slips, and falls

  • Minor to serious injuries due to physical activity

  • Damage to property or venue

I understand and voluntary accept all risks associated with the use of these games.

3. Release of Liability

In consideration for renting games from Giant Peach Game Rentals, LLC, I agree to release, waive, and hold harmless Giant Peach Game Rentals, LLC, its owners and employees from any and all claims, actions, damages, liabilities, costs, or expenses arising from or related to injury, property damage, or other incidents during the use of rented equipment.

4. Responsibility for Supervision and Use

I understand that:

  • The games must be used on a flat/semi-flat and dry/semi-dry surface

  • Adult supervision is required at all times

  • Roughhousing, horseplay, or misuse of the equipment is not permitted

  • I am fully responsible for ensuring proper and safe use of all rented equipment during the rental period

5. Equipment Damage or Loss

I agree to be financially responsible for any damage to or loss of rented items, beyond normal wear and tear, during the rental period.  I will inspect the equipment upon receipt and notify Giant Peach Game Rentals, LLC of any concerns immediately.

6. Cancellation Policy

I acknowledge and agree to the following cancellation terms:

  • Cancellations made 3 days or more prior to the event will receive a full refund, except for the non-refundable deposit if a non-refundable deposit was required at the time of booking.

  • Cancellations made 48 hours or less prior to the event will not receive a refund, except if due to weather.

    • If the event is cancelled or rescheduled due to weather and the games are intended to be used outside and there is no option to move games indoors, a full refund will be issued, except for the non-refundable deposit if a non-refundable deposit was required at the time of booking.

      • In order to cancel or reschedule the event due to inclement weather, Giant Peach Game Rentals, LLC must be notified and acknowledge the cancellation at least 24 hours prior to start time of event. 

  • No-shows or failure to accept delivery will result in a full charge with no refund.

7. Weather Policy

I understand and agree to the following weather-related terms:

  • If weather conditions become unsafe during the event, I will immediately stop using the games if being used outdoors, cover or store them to the best of my ability, and notify Giant Peach Game Rentals, LLC. 

  • If inclement weather conditions are expected and I have not contacted Giant Peach Game Rentals, LLC about cancellation 24 hours in advance of the event start time, I agree to use the game(s) indoors during the allotted rental service.

 

8. Setup and Pickup

  • Unless communicated prior to the event, setup will occur approximately 1 hour prior to the agreed upon duration period.

  • Unless communicated prior to the event, pickup will occur after the duration period.

  • Renter must ensure the setup area is clear, accessible, and safe.

 

9. Payment Terms

Payment for all rentals must be received in full no later than 48 hours prior to the scheduled event date and start time.  Failure to remit payment by this deadline may result in cancellation of the reservation, and Giant Peach Game Rentals, LLC reserves the right to rent the equipment to another Renter without further notice.

 

If a deposit is required to secure a reservation, the deposit must be paid by the date specified on the initial invoice.  The remaining balance will be invoiced separately and must be paid in full no later than 48 hours before the scheduled event date and start time.

 

Reservations are not considered confirmed until any required deposit has been received.  If the required deposit is not paid by the due date, Giant Peach Game Rentals, LLC reserves the right to cancel the reservation. 

 

Accepted payment methods include those specified by Giant Peach Game Rentals, LLC at the time of booking.  Any fees associated with declined, returned, or failed payments are the responsibility of the Renter.

 

Bookings made within 48 hours of the event date and start time require payment in full at the time of booking.  Reservations will not be confirmed until full payment has been received.

10. Acknowledgement

☐  By checking this box, I confirm that I have read and understand this waiver and agree to the terms and conditions outlined in this Rental Agreement, including but not limited to the Liability Waiver, Cancellation Policy, and Weather Policy.  I acknowledge that this waiver must be completed and signed by the Renter 3 days or more prior to the event, and if not, I understand the rental may be cancelled at the sole discretion of Giant Peach Game Rentals, LLC.  I acknowledge that I am voluntarily assuming all associated risks and responsibilities and confirm I am at least 18 years of age.
